Terms of use of the Waste Atlas
Preamble

D-WASTE Hellas Ltd. Athens, an environmental engineering and consulting firm sitting at 141 B, Acharnon Ave., 104 46 Athens, Greece ("D-WASTE ") provides users with the free use of a geographic information map ("Waste Atlas").

Waste Atlas is a custom-designed open source map, developed to store, analyze, manage, and visualize municipal solid waste ("MSW") production and management data for comparison and benchmarking purposes. Waste Atlas database is continually equipped and updated from scientists ("Contributors") across the world.

The access and use of Waste Atlas are subject to the following terms and conditions and all applicable Greek laws and European Directives. By using Waste Atlas, you agree to be bound by any such versions and should therefore periodically visit this page to review the current version of the Terms of Use. D-WASTE may at any time revise these Terms of Use by updating this posting.

1. Disclaimer

The information and material contained in Waste Atlas are provided "As is ", "As available". D-WASTE does not warrant the accuracy, adequacy, reliability or completeness of this information and materials and expressly disclaims liability for errors or omission in such Content. No warranty of any kind, implied, express or statutory, is given in conjunction with the Content.

2. Copyright

The Copyright of all Waste Atlas content including text, graphics, sounds, other items,or a combination of the above is owned by D-WASTE. No part or parts hereof may be reproduced, distributed, republished, displayed, broadcast, hyperlinked or transmitted in any manner or by any means or stored in an information retrieval system without the prior written permission of D-WASTE. You are permitted to download or print Contenton this Website for non-commercial, personal use only provided that you do not modify the material and you retain all copyright and other proprietary notices contained in the materials. The permission to use Waste Atlas is terminated automatically if you breach any of these conditions.

3. Trademarks

The Trademarks and logos used and displayed on Waste Atlas are registered and unregistered Trademarks of D-WASTE. Nothing on this website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on this website, without the written permission of D-WASTE, or other Trademark owner who is displayed on Waste Atlas.

4. Exclusion of liability

D-WASTE shall in no event be liable for any damages, loss or expense including without limitation, direct, indirect, incidental, or consequential damage, or economic loss arising from or in connection with:

   any access, use or the inability to access or use Waste Atlas, or reliance on the contents of Waste Atlas;
   any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus;
   any use of or access to any other website linked to this website;
   any product, service, or information of any merchant or service provider;
   even if D-WASTE is advised of the possibility of such damages, losses and/or expenses.

Any hyperlinks to any other websites are not an endorsement or verification of such websites and such websites should only be accessed at the user's own risks. This exclusion clause shall take effect to the fullest extent permitted by law.

5. Accountability

The geographic information map is based on data contributed from scientists across the world. Each Contributor has expressed a royalty free, worldwide, non exclusive permit towards D-WASTE to use, copy, adapt, edit, translate, reproduce, (re)publish, publicly display and perform, (re)distribute and (re)broadcast the sender's data, statistics, scripts, maps,coordinates, photos, or related materials. Each Contributor warrants to complying with national laws, legislation and any local or national regulations that may apply and to owning the right to grant permission to D-WASTE for the provided data. Each contributor warrants that the data don't contain any information that is unlawful, libelous, or violative of any person's right to privacy or publicity and that their supply is made under consideration of the protection of personal data. The above mentioned permit declarations is recorded from D-WASTE in a safe manner.

Since the Contributor of data is a public entity, the data is provided in accordance to the Greek Law 3979/2011 (Government Gazette A 138/16.06.2011) and the Greek Ministerial Decision YAP/F.40.4/1/989 (GG V1301 / 12.04.2012) which refers to entitlement to communicate and transact with individuals using Information and Communication Technology [ICT] and the right especially to use electronic information and communication systems to provide services of "eGovernment", receive and give information via internet.

Since the Contributor of data is a private entity, the data is provided in accordance to Article 1 of the Greek Ministerial Decision YAP / F. 40.4/1/989 No. 42 which foresees the provision of simple data information. Simple data is a data package information (including photography, comments and coordinates), which is publicly accessible and not personal data, protected by Data Protection Laws. As "Data Protection Laws" are considered all data protection, privacy or similar laws and regulations anywhere in the world applicable to the processing of personal data, including without limitation the Data Protection Act 1998, the Regulation of Investigatory Powers Act 2000, the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 and the Privacy and Electronic Communications (EC Directive) Regulations 2003.

In consideration of the use rights for which the permit has been granted from a Contributor to D-WASTE and in order to assist Waste Atlas to the proper use of the delivered data and be able to follow up the sources if necessary, D-WASTE requests and registers a "Senders Copyright attribution notice", a "Sender's Source attribution notice" and a "Sender's Trademark attribution notice".

6. IP Addresses and Anonymous Browsing

The user of Waste Atlas is able to use Waste Atlas anonymously without registering and providing personal information about himself. As with most website operators, D-WASTE maintain server logs that provide general information about Site visitors. This information may include a general location, the domain name used to access D-WASTE, the type and version of browser used, and the Internet Service provider.

By accessing and browsing the Site, you accept without limitation and qualification, all the terms and conditions.
